Terms & Conditions

Please read these terms carefully before booking. By confirming a booking with African Safari Trails Ltd you agree to be bound by them.

These terms and conditions apply to the tour/safari booking concluded between African Safari Trails Ltd (the “Company”) and the client at the time the booking is confirmed. All references to “client” include references to an agent of the client, with such changes as the context may require.

Applicable law & jurisdiction

  • These terms and conditions are deemed to have been concluded in Kampala, Uganda, and are interpreted according to the laws of the Republic of Uganda.
  • The client must at all times comply with the laws, customs, foreign-exchange and other regulations of all countries visited on the tour/safari.

Bookings

  • The Company reserves the right not to confirm a booking until the full amount set out in the invoice has been paid and received by the Company, and all relevant documentation has been signed and completed in full by the client.
  • Any amendment to, or cancellation of, the booking is subject to these terms and conditions.

Child policy

  • Children are welcome to travel with African Safari Trails on a request basis and must be accompanied by an adult.
  • Children aged 16–18 are welcome to travel with African Safari Trails Ltd but will require a letter of consent signed by a parent or guardian.

Tour price, deposit & payment

A non-refundable 25% deposit secures your booking. The balance is due no later than 30 days before departure. Bookings made within 30 days of departure require full payment upfront.
  • While the Company uses its best endeavours to ensure the accuracy of the tour/safari price, the price is subject to change as a result of factors beyond the Company’s reasonable control. The Company will use its best efforts to notify clients of any such change as soon as possible.
  • The price includes only those services and items set out in the itinerary and tour profile. The client is responsible for, and must pay for, any additional items, whether paid directly to a third-party provider or to the Company for settlement with a third-party provider.
  • Certain prices, charges and tariffs are determined by the public regulations of a particular country. The Company has no control over increases in such charges, including increases implemented during the tour/safari, and reserves the right, in its sole discretion, to increase the relevant amounts to account for them.
  • A non-refundable 25% deposit is required to secure the booking and is set off against the tour/safari price.
  • The tour/safari price must be paid no later than 30 days before the departure date, failing which the Company may treat the booking as cancelled and levy the cancellation penalties below.
  • If a booking is made within 30 days of departure, the full tour/safari price is payable upfront to secure the booking.

Cancellations

Where a booking is cancelled at any time up to 30 days before departure, for any reason, the client forfeits the non-refundable deposit. Where a booking is cancelled less than 30 days before departure, the following penalties apply:

7–14 days before departure 75% of the tour/safari price
Less than 7 days before departure, or “no-shows” 100% of the tour/safari price
  • The Company may apply any portion of the non-refundable deposit toward any cancellation penalty payable.
  • The Company reserves the right, at any time and for any reason, to cancel the tour/safari on notice to the client. In that event the Company will refund the tour/safari price (including the deposit). This refund is the Company’s sole responsibility, and no claim for damages of any kind shall accrue against the Company as a result of such cancellation.

Amendments to bookings

  • If the client joins the tour/safari after the departure date, or leaves before its completion for any reason, the client is not entitled to any refund or rebate from the Company.
  • Where the client wishes to move from the confirmed tour/safari to another, such amendments are subject to: the Company being able to accommodate the client on the substituted tour/safari; payment by the client of an administrative fee; the change being made no later than 30 days before the original departure date (failing which the cancellation penalties apply); and these terms and conditions applying to the substituted tour/safari, with the necessary changes.

Passports, visas & travel papers

  • It is the client’s sole responsibility to ensure that passports, visas, health certificates, proof of vaccinations and any other required documentation are valid for all countries visited on the tour/safari.
  • The Company shall not be held liable for any consequences, damages or claims if the client does not correctly attend to their documentation and related matters.

Insurance

Comprehensive travel and cancellation insurance, including medical cover and provision for air evacuation, is mandatory on every tour.
  • It is the client’s responsibility to have such insurance in place, together with the paperwork to prove it, before embarking on the tour/safari.
  • Should the client be unable to present proof of insurance on request, the Company may, in its sole discretion, exclude the client from the tour, and the client will be liable for the cancellation penalties set out above.
  • The travel insurance must include comprehensive medical cover, including provision for air evacuation. The Company shall not be liable for any consequences, damages or loss resulting from the client failing to hold the necessary cover.

Baggage

  • The client is responsible for all baggage and personal effects brought on the tour/safari. The Company shall not be liable for any loss of or damage to such baggage or personal effects, however arising.
  • The client is entitled to one bag/suitcase weighing no more than 23 kilograms, plus a daypack. A larger allowance may be arranged with the Company against a fee levied in its sole discretion. The Company reserves the right to refuse excess baggage.

Health

  • The client accepts that participating in the tour/safari requires a measure of physical fitness and health, and should ensure they are medically fit to take part.
  • Where the client is over the age of 68, the Company requires a medical certificate or doctor’s letter confirming that the client is medically fit to undertake the tour/safari.

Authority on tour/safari

  • The client must at all times comply with the laws, customs and foreign-exchange regulations of all countries visited during the tour/safari.
  • Any disruptive, dangerous or potentially dangerous behaviour will not be tolerated. The Company, its employees, representatives, agents and/or contractors reserve the right to exclude the client from the tour/safari at any point in such circumstances.
  • The Company shall not be liable for any costs or expenses resulting from such exclusion, and the client is not entitled to any refund, rebate or additional compensation.

Marketing

  • The Company reserves the right to use any photographs and videos taken during the tour/safari in marketing or other advertising material, and the client consents to such use.
  • The client agrees that the Company retains copyright over any such photographs and videos and, to the extent necessary, assigns copyright in them to the Company.

Force majeure

Unforeseen circumstances, including but not limited to war, mechanical breakdowns, weather, riots and other reasons beyond the Company’s control, may cause delays or alterations to the tour/safari. The Company shall not be held liable in any way for any such occurrence, or for any consequences arising from it.

Travel documents

On booking, the client is issued with our tour/safari itinerary and pre-departure information documents. It is the client’s responsibility to read and understand these documents before travelling.

Indemnification & exclusion of liability

The client accepts that the tour is adventurous and involves an element of personal risk. The Company and its directors, officers, employees, representatives and agents shall not be liable for any loss or damage of whatever nature and however arising, including, but not limited to, the client’s or any other person’s injury or death, or any loss of or damage to the client’s or any other person’s property, which the client or any other person may incur or suffer as a result of, or arising from, the client’s participation in the tour and any other activities undertaken during it. The client irrevocably and forever releases and discharges the Company and its directors, officers, employees, representatives and agents from any such liability.

The client further indemnifies and holds the Company and its directors, officers, employees, representatives and agents harmless from and against any and all loss, damage, actions, proceedings, claims, demands and legal and other costs and expenses (including legal costs on an attorney-and-own-client scale) of whatever nature and however arising, including, but not limited to, the client’s or any other person’s injury or death, or any loss of or damage to the client’s or any other person’s property, which the client or any other person may incur or suffer as a result of, or arising from, the client’s participation in the tour/safari and any other activities undertaken during it.
